1. Acceptance of Terms

By accessing or using the Shurwaat website (shurwaat.com), mobile application, or any related services (collectively, the "Platform"), you agree to be bound by these Terms and Conditions. If you do not agree to all of these terms, please do not use our Platform.

2. Services Description

Shurwaat operates an online platform that allows users to order food items (both vegetarian and non-vegetarian) from our restaurant for delivery or pickup. We strive to provide accurate descriptions and images of our food items, but we do not warrant that such descriptions or images are accurate, complete, reliable, current, or error-free.

3. User Account

To access certain features of our Platform, you may be required to create an account. You are responsible for maintaining the confidentiality of your account information, including your password, and for all activity that occurs under your account.

4. Placing Orders

When you place an order through our Platform, it constitutes an offer to purchase the food items selected. We will send you a confirmation email once we have received your order. The contract for the purchase of food items is formed when we send this confirmation.

We reserve the right to refuse or cancel any order for any reason, including limitations on quantities available for purchase, inaccuracies, or errors in product or pricing information, or problems identified by our credit and fraud avoidance department.

5. Pricing and Payment

All prices listed on the Platform are in Indian Rupees (₹) and are subject to change without notice. The total price for your order will include the cost of food items, applicable taxes, and delivery charges (if any).

We accept various forms of payment as indicated on the Platform. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Platform.

6. Delivery

We will deliver the ordered food items to the address specified in your order. Estimated delivery times are provided for reference only and we cannot guarantee that orders will be delivered within the estimated timeframes.

7. Cancellation and Refunds

You may cancel your order within 5 minutes of placing it without any cancellation charges. After this period, cancellation may not be possible if we have already started preparing your order.

Refunds, if applicable, will be processed using the original payment method within 7-10 business days. Please refer to our detailed Refund Policy for more information.

8. User Conduct

You agree not to use the Platform:

• For any unlawful purpose
• To submit false or misleading information
• To impersonate or attempt to impersonate Shurwaat, a Shurwaat employee, another user, or any other person or entity
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Platform

9. Intellectual Property

The Platform and its original content, features, and functionality are owned by Shurwaat and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, reproduce, distribute, transmit, display, sell, license, or otherwise exploit any content from our Platform without prior written consent from us.

10. Limitation of Liability

In no event shall Shurwaat, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Platform
• Any conduct or content of any third party on the Platform
• Any unauthorized access to or use of our servers and/or any personal information stored therein

11. Indemnification

You agree to defend, indemnify and hold harmless Shurwaat and its licensees and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses, resulting from or arising out of your use and access of the Platform, or a breach of these Terms.

12. Termination

We may terminate or suspend your account and bar access to the Platform immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Lucknow, Uttar Pradesh, India.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days' notice prior to any new terms taking effect.

By continuing to access or use our Platform after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Platform.
